Terms of use

These terms are an agreement between you and Orca Labs LLC ("Orca Labs", "we", "us") for the WA Fuel Refund app and the website www.wafuelrefund.com (together, the "Service"). By downloading or using the Service you agree to these terms and to our privacy policy. If you don't agree, don't use the Service.

1. What the Service does

WA Fuel Refund helps you keep fuel receipts for your boat and prepare Washington fuel tax refund claims. It reads your receipts, estimates refunds using the rates published by the Washington State Department of Licensing ("DOL"), groups receipts into claims, and fills in claims on DOL's License eXpress website for you to review and submit.

2. Not affiliated with DOL

The Service isn't made by, endorsed by or affiliated with DOL or any government agency, and we don't file claims on your behalf as your agent or tax preparer. DOL alone decides whether a claim qualifies, how much is refunded, and when.

3. Your responsibilities

• You must be at least 18 and able to enter into this agreement.
• Claims are made in your name and under your DOL account. You're responsible for reviewing everything the app fills in before you certify and submit it.
• Only claim fuel that qualifies for a refund under Washington law, and keep your receipts and records as DOL requires.
• Provide accurate information, and check each receipt's date, total and gallons; receipt reading can make mistakes.
• Keep your phone and your License eXpress sign-in secure. You're responsible for activity under your DOL account.

4. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your own refund claims, in line with these terms and the rules of the app store you got it from. You may not copy, modify, reverse engineer, resell or distribute the app, use it to file claims for others as a business, or use it in any way that breaks the law or interferes with DOL's systems.

5. Ownership

The Service, including its software, design and content, belongs to Orca Labs and its licensors. Your receipts, photos and claim information belong to you.

6. Third-party services

The Service works with DOL's License eXpress website and published rates, and is distributed through Apple's App Store and Google Play. Those services are run by others under their own terms. We aren't responsible for them, and changes to them (for example to DOL's website, rules or rates) may stop parts of the Service from working until we update it.

7. Estimates and accuracy

Refund amounts shown in the app are estimates until DOL calculates them, and may differ from what DOL pays. Rates, deductions and rules are set by DOL and can change. The Service isn't tax, legal or financial advice.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY CLAIM WILL BE ACCEPTED OR PAID.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ORCA LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF REFUNDS, PROFITS, DATA OR GOODWILL, INCLUDING REFUNDS THAT ARE DENIED, REDUCED, DELAYED OR MISSED, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR US$50. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

10. Indemnity

You agree to indemnify and hold Orca Labs harmless from claims, losses and expenses (including reasonable legal fees) arising from claims you file, your misuse of the Service, or your breach of these terms.

11. Ending use

You can stop using the Service at any time by deleting the app. We may suspend or end the Service, or your license, if you break these terms or if we stop offering the Service. Sections 5 and 7 to 14 survive.

12. Changes

We may update these terms. We'll change the effective date above and, for significant changes, tell you in the app. Continuing to use the Service after a change means you accept the new terms.

13. Governing law and disputes

These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Washington, and you and Orca Labs consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally.

14. General

These terms and the privacy policy are the entire agreement between you and Orca Labs about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term isn't a waiver. You may not transfer these terms; we may transfer them in connection with a sale or reorganization.

15. Apple App Store

If you got the app from Apple's App Store, these additional terms apply:

• These terms are between you and Orca Labs only, not Apple. Orca Labs, not Apple, is solely responsible for the app and its content.
• Your license is limited to use on Apple devices you own or control, as permitted by the App Store's Usage Rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• Orca Labs, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
• If a third party claims the app infringes their intellectual property, Orca Labs, not Apple, is responsible for the investigation and resolution.
• You confirm that you aren't in a country subject to a U.S. government embargo and aren't on a U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
